02Prohibited Activities — Illegal or Harmful Use

- Building systems intended to harm, harass, stalk, discriminate against, or violate the rights of individuals.
- Using our services to generate or distribute child sexual abuse material (CSAM) or any content exploiting minors — this will be reported to law enforcement immediately.
03Prohibited Activities — Technical Misuse
- Attempting to access, probe, test, scan, or exploit the security of our systems, servers, or networks without explicit written authorisation.
- Scraping, crawling, harvesting, or extracting content from our website using automated tools.
- Reverse engineering, decompiling, or disassembling any proprietary software, tools, or systems used or provided by Sofeat.
- Transmitting malware, ransomware, viruses, trojans, worms, or any malicious code through our systems or within deliverables.
- Conducting denial-of-service (DoS), distributed denial-of-service (DDoS), or other attacks against our infrastructure or third-party systems.
- Attempting to gain unauthorised access to any account, system, or network — including those of our other clients.
04Prohibited Activities — Communications & Content
- Sending spam, unsolicited bulk email, or unsolicited commercial communications through our contact channels.
- Impersonating Sofeat, our team members, or any other person, company, or entity.
- Submitting false, misleading, or fraudulent information to us at any time.
- Using our brand, logo, or name in any way that implies endorsement without prior written consent.
05Content Standards
- All content, assets, data, copy, and materials you provide to Sofeat must not infringe any third-party intellectual property, privacy, or other rights.
- Content must not be defamatory, obscene, discriminatory, offensive, threatening, or in breach of any applicable law.
- You must have appropriate rights, licences, and permissions for all third-party materials you ask us to incorporate into your project.
- You are solely responsible for ensuring that the products and services you commission from Sofeat comply with applicable laws, regulations, and industry standards in your jurisdiction(s).
06Security & Responsible Disclosure
- You must not circumvent, disable, or interfere with any security features of our website or systems.
- If you discover a security vulnerability affecting our website or services, please disclose it responsibly by contacting karan.rajput@sofeat.in before publishing or sharing any details.
- We reserve the right to block IP addresses, cancel accounts, or take other protective measures against suspected abuse without prior notice.
07Indemnification
You agree to indemnify, defend, and hold harmless Sofeat and its directors, employees, contractors, agents, and successors from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of our website or services; (b) your violation of this AUP; (c) any content or materials you provide to us; (d) your infringement of any third-party rights; or (e) any product or service you develop using our Deliverables. This indemnification obligation survives termination of any engagement.
08Consequences of Violation
- Sofeat may immediately suspend or terminate services, without liability and without refund, if we reasonably believe a violation of this policy has occurred.
- We reserve the right to pursue all available legal remedies, including injunctive relief and damages, in the event of a material breach.
- We will cooperate fully with law enforcement authorities and regulatory bodies in connection with any investigation of suspected illegal activity.
- Sofeat's decision to suspend or terminate services under this clause shall not affect any accrued rights or liabilities.
09Reporting Abuse
If you become aware of any violation of this policy — including any misuse of our services or harmful content — please report it immediately to karan.rajput@sofeat.in. We take all reports seriously and will investigate promptly. Whistleblowers reporting in good faith will not face adverse consequences.
10Governing Law
This AUP is governed by English law and forms part of our Terms of Service. In the event of any conflict between this AUP and our Terms of Service, the Terms of Service shall prevail.
11Changes to This Policy
We may update this policy at any time to reflect changes in our services, technology, or legal obligations. Continued use of our website or services after changes are posted constitutes acceptance of the updated policy.
